본 연구는 영국, 호주, 그리고 한국에서 외국인 유학생에 대한 복지권 권리 형성과 변화에 대해 비교·분석하고, 한국 유학생 (복지권) 관련 정책의 개선방안을 모색하는데 목적이 있다. 먼저, 각 국의 유학생에 대한 복지권을 살펴보기에 앞서, 서구 복지국가의 이민레짐과 복지레짐이 어떻게 이민자의 복지권을 형성하는지에 대한 선행연구를 검토 하여, 유학생의 복지권 연구를 위한 분석틀을 제시하였다. 다음으로, 보건의료와 경제활 동 분야를 중심으로, 영국, 호주, 그리고 한국 등 세 국가의 외국인 유학생 복지권에 대한 비교사례분석을 실시하였다. 그 결과, 법제도적 차원에서 유학생의 복지권은 상당 부분 보장되었으나, 분야에 따라 보장 여부와 정도에 있어 차이가 확인되었다. 구체적으로, 세 국가 모두 경제활동에 대한 권리를 법적으로 보장 및 지원하고 있으나, 보건의료와 관련 한 권리 보장은 다소 미흡한 측면이 있다. 마지막으로, 세 국가 간의 비교를 통해 한국의 유학생 (복지권) 관련 정책에 주는 시사점을 제시하였다.

This study aims to analyze the formation and change of welfare rights for international students in the UK, Australia and South Korea and draw its policy implications. First, in the literature review part, we examine how immigration regimes and welfare regimes shape the welfare rights of immigrants, and suggest an analytical framework of the welfare rights of international students. Next, a comparative analysis of the welfare rights of international students are conducted, especially centering on their entitlement to health care and economic activities. We find that in general the welfare rights of international students are guaranteed to a more significant extent at the legal and institutional level. However, some differences are identified in terms of the availability and status of coverage in each field. Specifically, the right to economic activities is legally guaranteed in each country, whereas the level of healthcare guaranteed through the policy is relatively low. Finally, policy implications for the welfare rights of international students in Korea are drawn from the comparative analysis of three countries.
